General Conditions of Sale These general conditions of sale (the "General Conditions") constitute the conditions applicable to the sale of products (the "Products") marketed by LOMBARDA CORNICI S.n.c. a company whose registered office is located at Via G. Marconi, 24, 20080 Vermezzo (MI) - Italy, VAT number IT12860880157, via its website www.artisancadre.fr (the "Site") and in general to the relations between LOMBARDA CORNICI S.n.c. and the buyers of the products marketed via the Site (each, the "Customer"). Each time the Customer places an order on the Site, he/she will be expressly asked to accept the General Conditions and this acceptance will be deemed to be full and complete acceptance by the Customer of all the terms contained in the General Conditions in force on the date of the order and acceptance of the act that LOMBARDA CORNICI S.n.c. does not consider itself bound by different conditions, unless previously agreed in writing with the Customer. The Customer is therefore required to read the General Conditions carefully. LOMBARDA CORNICI S.n.c. reserves the right, at its sole discretion, to modify, extend, delete in whole or in part, at any time and without notice, any part of the General Conditions. The modifications will come into force as soon as they are published on the Site. 1. Products: prices and characteristics 1.1 Unless otherwise indicated, the prices of the Products published on the site are expressed in Euros, excluding delivery costs. Shipments outside the European Community (outside the EU) are also free of any customs duties, which will be borne by the recipient and will be requested by the sender upon delivery. The price guaranteed to the buyer is the one published on the Site at the time the order is sent. The purchase price is fixed and final. The prices of the Products published punctually on the site cancel and replace the previous ones and are subject to the actual availability of the Products. The technical and functional characteristics relating to the Products published on the site through their own information messages on the web pages describing the items, are those communicated by the respective manufacturers. LOMBARDA CORNICI S.n.c. assumes no responsibility for the accuracy and completeness of this information. The images of the products are indicative and not contractual. The Products are not provided for testing. Although the operators of the site may provide information on the characteristics of the Products, the Customer is responsible for the choice of the Products ordered as well as the correspondence and conformity of the specifications indicated by each manufacturer to his needs. 2. Orders Each order for Products sent to LOMBARDA CORNICI S.n.c. constitutes the contractual proposal of the Customer. The execution of the order by LOMBARDA CORNICI S.n.c. is equivalent to the confirmation and acceptance of the same. 3. Execution of the order The order will be executed under the conditions specified on the Site. In the event of non-execution of the order by LOMBARDA CORNICI S.n.c. (if this is due to the unavailability of the Products ordered by the Customer), LOMBARDA CORNICI S.n.c. will inform the Customer as soon as possible of the delivery times expected for the supply of the missing Product. If the Customer does not intend to wait for this period, LOMBARDA CORNICI S.n.c. will refund the amounts already paid by them for the unperformed supply. In the event of a breakdown, exhaustion of stock(s) or unavailability of the Product ordered, LOMBARDA CORNICI S.n.c. undertakes to inform the Customer as soon as possible and to specify a time limit for making it available. The Customer will confirm their choice by e-mail, i.e. wait for the availability of the Product or request a refund. 4. Acceptance of the order The conclusion of the contract will only take place after confirmation of the order by LOMBARDA CORNICI S.n.c. The Customer will receive by fax, mail or e-mail a receipt containing the order confirmation with all the elements constituting the contract (products ordered, prices, delivery dates, shipping costs, etc.) LOMBARDA CORNICI S.n.c. reserves the right not to confirm an order for any reason related in particular to a problem of supply of the products, or to a problem concerning the order received. 5. Delivery of the Products The Products will be delivered to the address indicated by the Customer. Shipments will take place after receipt of confirmation of payments: for payment by credit card, confirmation of the transaction by the circuit. For our shipments, we rely on the express courier service. The times depend on the carrier and are communicated for information purposes at the time of order confirmation.  LOMBARDA CORNICI S.n.c. recommends that the Customer check the condition of the Products delivered before signing the acknowledgement of receipt, and in particular: - that the number of packages delivered corresponds to that indicated in the transport document attached to the shipment; - that the packaging is intact, not damaged, wet or otherwise altered, and to check the integrity of the contents. If the Customer notices any anomalies, he must refuse delivery of the products or formulate in writing his detailed and dated reservations. If the carrier's document is signed without affixing a "reservation", the Customer may not make any objections to the external characteristics of what has been delivered. Any problem concerning the physical integrity, correspondence or completeness of the Products received must be reported within 3 (three) days of delivery. LOMBARDA CORNICI S.n.c. has the right, at its sole discretion, to deliver the Products ordered through a courier of your choice. Unless otherwise specified, all deliveries are made to street level. Special delivery conditions must be agreed in advance between the Customer and LOMBARDA CORNICI S.n.c. and accepted in writing by LOMBARDA CORNICI S.n.c. 6. Collection of products in the event of the Customer's absence In the event of the recipient's absence at the time of delivery, the carrier will leave a calling card at the delivery address indicated by the Customer. The Products must be collected from the address and in the manner indicated by the carrier. In the event of non-collection within the time limit set by the carrier, the Products will be returned to LOMBARDA CORNICI S.n.c., which reserves the right to refund the price of the Products, leaving the shipping costs to be borne by the Customer. In the event of an error relating to the Product, the Customer undertakes to return the Product(s) concerned to LOMBARDA CORNICI S.n.c. within 7 (seven) days of receipt, provided that they are returned unopened, in their original condition and packaging with the accompanying documents. Once the Product has been received in the correct form and manner, LOMBARDA CORNICI S.n.c. will return, at its own expense, the Product initially ordered. 7. Force majeure In addition to those normally retained by case law, the following cases are expressly considered to be cases of force majeure: - total or partial strikes, internal or external to the company, blockage of means of transport or supply for any reason whatsoever, governmental or legal restrictions, computer breakdowns, blockage of telecommunications including networks and in particular the internet. In the event of force majeure, the execution of the order will be suspended, initially, automatically. If after a period of 3 (three) months, the parties note the persistence of the force majeure event, the order will be automatically cancelled, unless otherwise agreed by both parties. 9. Right of withdrawal 9.1 In accordance with art. 5 of Legislative Decree 22 May 1999 n. 185, the Customer (if qualified as a "consumer" in accordance with article 1 letter b) of Legislative Decree 22 May 1999 n. 185) has the right to terminate the contract and return the Products ordered, without any penalty and without specifying the reason, within 14 (fourteen) days of receipt of the Products. 9.2 The right of withdrawal referred to in article 9.1 above may be exercised by the Customer, without indicating the reasons, within 14 days. The withdrawal period expires fourteen days after the day on which the Customer or a third party, other than the carrier and designated by the Customer, takes physical possession of the goods. To comply with the withdrawal period, it is sufficient for the Customer (consumer) to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires. 9.3 Effects of withdrawal By withdrawing from the contract, the Customer (consumer) will be reimbursed all payments made to us, including delivery costs (with the exception of the supplementary costs resulting from the possible choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event within thirty days from the date of return of the product in the manner and under the conditions indicated. These reimbursements will be made using the same means of payment as you used for the initial transaction, unless the Customer has expressly agreed otherwise. 9.4 Returned goods must be returned to us  urned or delivered to the address LOMBARDA CORNICI S.n.c. - Via G. The deadline is met if the goods are returned before the expiry of the 14-day period. The direct costs of returning the goods will be borne by the customer. 9.5 The Customer is only liable for the decrease in the value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods. Returned goods must be returned in resalable conditions. The product must not be compromised in any way. 9.6 The right of withdrawal referred to in Article 9.1 above cannot be exercised by the Customer if the Products purchased have been made according to the Customer's requests, are personalized, or are likely to deteriorate or expire quickly. 9.7 Withdrawal by the supplier LOMBARDA CORNICI S.n.c., in the event of being unable to execute the requested order due to the unavailability, even temporary, of the product ordered, it has the right to terminate the sales contract within 40 days from the date of the order by providing the customer with a simple reasoned communication, in accordance with art. 54, paragraph 2 of Legislative Decree 206
